Guys, tanong lang. meron akong friend na nagpaplano ng immediate resignation sabi sa labor code you have to give the company 30 days to find your replacement and for you to endorse your work to someone. If in case na di na sya pumasok after submitting the resignation ano po ang mangyayari sa employee?

need your opinion po.

kapag nag agree siya sa 30 day period.. ma coconsider siya as AWOL absense without official leaves and hindi na siya makakatanggap ng back pay at other benefits from being a former employee....

kapag valid naman yung immediate resignation at pinayagan sa agreed date pwede na siyang hndi pumasok.....

so need pa rin nya inform sng company na di na sya papasok prior to 30th day effectivity?

nasa usapan yan kasi minsan kung kailangan ka talaga ng company at mahihirapan sila na humanap ng kapalit ay mapipilitan sila na gamitin ang batas at pwersahin ka na mag stay muna pero kung di naman ganun ka importante yun position na pede naman saluhin muna ng iba ay di na sila magrereklamo dahil matagal at magastos pa yan kung iaakyat pa sa korte.

sken ok lang. dba may cut off? tpos smen kze 7 days na consecutive absences bgo ihold sweldo so ang ginawa kuh is pmasok akuh first 2 days after ng sweldo march 1-2 then absent nkuh gang march 10 so ang days na dkuh pinasok is 3,4,5,8,9,10 so receive kuh pa salary kuh today. pro pinakaqusteion kuh is regarding article 285 of labor code, kung applicable ba xa sa call center industry. lam nyu nman kze sa callcenter industry dami attrition. ska idahilan kuh sana ung ginawa ng team lead kuh na sinigawan nea kuh during our meeting, which i think is good for my case nman since i have witnesses. ke alang i'm not sure kung pasok sya sa article 285 "1. Serious insult by the employer or his representative on the honor and person of the employee;"

nung nag immediate resign ako di ako pinayagan kaya tiis na lang sa 1 month....

i believe, and kalabasan niyan is absence without leave or AWOL. naku, hindi magandang record yan if your friend plans of looking for job opportunities. kung urgent talaga yung reason niya, pwede niya naman kausapin yung boss niya, mag negotiate siya. kung granted naman ng office, wala namang problema yun.

basahin niya muna mabuti ang pinirmahan niya na contract kasi kapag hindi siya sumunod sa contract magkakaproblema siya kasi for sure gagawa ng legal action ang company
