"Contract to sell" may condition or maaring installment ang bentahan, "Absolute deed of sale" bentahang fully paid at walang condition.

in my own words and experience:
a CONTRACT TO SELL is commonly used for a sale wherein the two parties (buyer and seller) agree for a downpayment  and the  balance on installments. We write whatever conditions/stipulations both parties agreed into.

An ABSOLUTE Deed of Sale is executed for Full Cash Payment wherein the Seller agrees to pay  usually the agent/broker's commission/compensation and Capital Gains tax  and Documentary Fee, while  the buyer pays  for the Transfer/ Registration fees and the Notarial Fees.

Yong Deed of Absolute Sale (DOS) is for cash payments ng isang property while the Contract to Sell (CTS) is for payments with terms like in-house, bank financing or Pag-ibig Financing. Maari rin yan gawin if the property for sale by individual owners, be sure you make the contract (DOS or CTS) in front of the real estate broker and a lawyer to make it more legal and no law suits in the future.
SsD kung meron po kayong natutunan, yan naman talaga ang purpose ng thread na to.

DEED OF ABSOLUTE SALE if the house and lot was paid in SPOT CASH or when the previous Installment plan was fully settled/paid off.

ang deed of absolute sale [DOAS] ay pangkalahatang [general] kasulatan ng bibili at ng pinagbilhan. samantalang ang contract to sell [CTS] ay detalyadong kasunduan ng bibili at pinagbilhan kasama na ang kasunduan ng kung paano babayaran, paano ibibigay [turnover] , ilang probisyon tungkol sa buwis, tubig at ilaw at ilang mahahalagang bagay na may kinalaman sa bahay. kadalasan ang DOAS ay ibinibigay ng pinagbilhan pabor sa bibili at tagapagmana nito. Samantalang ang CTS naman ay nagiging real estate mortage [REM] pabor sa nagpondo [financing institution] upang sa huli, ang bumili aymagpaptupad ng loan and mortage agreement [LMA] pabor sa pinagbilhan.

ate, pag spot cash wala ng cts pero pag hulugan, may cts which include a doas [doas to be executed by the vendor in favor of the vendee and tagapagmana niya..]

Ate pag binayaran ng isang client ang isang property ng cash, ngunit wala pang titulo ang property, puede na ba siyang pumirma ng DOAS or Deed of Absolute Sale?
