Deed of Donation of a Real Property: with Capital Gains or none?

Hi Real Estate Gurus,

May I ask if I make a Deed of Donation of a Real Property to somebody, would I still pay the Capital Gains Tax?  What else do I need to know about this?

walang capital gains kasi nga hindi ka naman kumita. nadonate lang.

hindi na kasi dapat meron legal paper yon at kung sino ang nakasaad don na tunay na mayari sila na responsible sa tax

Thanks. Therefore, ang expenses na lang would be the transfer of TCT and Doc stamps? Tama po ba?

walang cap gains.. pero may donor's and donee's taxes... but if u add up the 2 taxes... mas mababa pa rin kesa cap gains...

Oh i see.  Do you have any idea about the percentage cost of those taxes?  Ex: 5% of the lot cost...

no idea... but you can ask the ONETT section of the BIR branch where you're supposed to pay... these are just the taxes ha... we're not talking about the transfer fees and all other expenses...

Deed of Donation- Donors Tax

Deed of Sale- Capital Gains Tax

BIR would determine which among these i.e. Deed of Donation, Tax Declaration, Zonal Valuation it will use to compute for TAX.
